Responsibilities for Landlords and Tenants - Written rental agreements

The Declaration of Covenants, Conditions, and Restrictions (CC&R's) specify in section 4.4.1 Written Rental Agreements Required, with the following requirements:
  • The Owner and tenant must enter into a written rental agreement,
  • The agreement specifically state that the tenant is subject to all provisions of the Declaration, By-Laws, and Rules and Regulations, and
  • The tenant's failure to comply constitutes default under the rental or lease agreement.
Section 4.4.3 Tenant Must Be Given Documents states that the Owner must provide the tenant with a copy of the Declaration, By-Laws, and Rules and Regulations.

Below is an example of a portion of an "addendum" one Owner has added to the written rental agreement they use with their tenants. Note that a space is provided for the tenant to initial that they have read and understand the requirement. Also note that the addendum satisfies the requirement to provide copies of the Declaration, By-Laws, and Rules and Regulations through a link to the Stanford Townhomes web site.
_____ (for tenant to initial) Tenant agrees that failure to comply with any of the provisions of the Declaration, the Bylaws, and Rules and Regulations (governing documents) shall constitute a default under the lease agreement; including but not limited to: parking tenant's primary vehicle in the garage, keeping all trash and recycling containers out of sight between trash/recycling pick up days, or engaging in noxious, harmful or offensive activities that is a source of annoyance to other occupants. The Board is empowered under section 11.3 Enforcement to enforce any or all violations to the CC&Rs against the Owner. The method of enforcement is stipulated through the Financial Penalties Resolution. Enforcement can take the form of monetary fines and can be secured through liens placed on the Owner's real property at Stanford Townhomes.

Trash and Recycling Containers

The most common violation by tenants of the Declaration, By-Laws, and Rules and Regulations is failure to place trash and recycling containers "out of public view" as stipulated under section 4.10 Rubbish and Trash.

Owner's are encouraged to download and post this notice on the inside of the door leading from the garage to the common area.


Parking is reserved for residents and guests. Vehicles deemed in violation are subject to being towed at the vehicle owner's expense. A section of the parking lot is designated for "Motorcycles Only". This is desined to not have a motorcycle take up a single parking spot and to facilitate the residents of the unit on the corner of Windflower and Stanford streets to back out of their garage.

Window Air Conditioners

Air conditioning units which extend outside of the window frame and which are visible from the outside of the building are prohibited under the Window Air Conditioning Resolution.
